Terms of use

1. The service

DialHRM helps the customer record attendance, manage leave, work out salaries and run HR tasks for its staff. We keep improving it. If we remove a feature that paying customers use, we tell them at least 30 days before.

2. Accounts

  • The customer’s admins create accounts for their staff and decide what each person can see and do.
  • Keep your password and your kiosk PIN to yourself. You are responsible for what is done with your account.
  • If you think someone else has used your account, tell your company’s admin or us straight away.

3. What the customer is responsible for

  • The customer decides what staff data goes into DialHRM. It must have a lawful reason for collecting it, give its staff the notices the law requires (including under the Digital Personal Data Protection Act, 2023) and keep the data accurate.
  • The salary, deductions and statutory amounts that DialHRM works out depend on the data and settings the customer enters. The customer must check them before paying staff or filing returns. DialHRM is a tool; it is not legal, tax or payroll advice.
  • The customer is responsible for its admins and staff following these terms.

4. What nobody may do

  • Use DialHRM to break the law or anyone’s rights.
  • Try to see another company’s data, or any part of our systems beyond what your account allows.
  • Test DialHRM for security weaknesses without our written permission. If you find one, please tell us at office@creativedial.in.
  • Upload malicious software, overload the service, or collect data from it with automated tools.
  • Copy, resell or take apart (reverse-engineer) the service.

5. Fees

  • Fees are as agreed in the customer’s plan or quotation. Prices do not include GST, which is added at the applicable rate.
  • A free trial runs for the period we offer, with no charge unless the customer continues.
  • If an invoice is still unpaid 30 days after it is due, we may suspend the account after giving 7 days’ notice. Suspension does not delete any data.
  • Fees already paid for a period that has started are not refunded, except where the law requires it.

6. The customer’s data

  • The customer owns its data. We use it only to provide and support DialHRM, as described in our privacy policy, and as the law requires.
  • The customer can ask for a copy of its data, in a common format such as Excel, at any time and for up to 90 days after its account ends. After that we delete it as the privacy policy describes.

7. Keeping DialHRM running

We work to keep DialHRM available and secure, but we cannot promise that it will never be interrupted. Where we can, we do planned maintenance outside Indian business hours. Support is by email at office@creativedial.in.

8. Ending the agreement

  • The customer can stop using DialHRM at any time by telling us.
  • We may suspend or close an account that seriously breaks these terms or puts other customers at risk, giving notice where we reasonably can.
  • Money already owed, section 6 on the customer’s data and section 9 on liability continue after the agreement ends.

9. Liability

  • Nothing in these terms limits a liability that the law does not allow to be limited.
  • Apart from that, we are not liable for indirect or consequential losses, such as lost profits, or for losses caused by data the customer entered wrongly.
  • Our total liability in any 12-month period is limited to the fees the customer paid us for DialHRM in that period.

10. Changes to these terms

We tell each customer’s admins at least 30 days before a change that matters. Using DialHRM after the change takes effect means accepting it.

11. Law and disputes

These terms are governed by the laws of India. We will first try to settle any disagreement by talking. If that fails, the courts at Delhi have exclusive jurisdiction.
